These Terms of Use (“Terms”) govern your access to and use of sovexperiences.com and any related websites, forms, content, communications, and online services operated by Sovereign Luxury Experiences (“Sovereign,” “we,” “us,” or “our”) (collectively, the “Site”).

By accessing or using the Site, you accept and agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Scope of These Terms

These Terms apply to your use of the Site and online interactions with Sovereign, including browsing the Site, submitting inquiries, requesting proposals, subscribing to emails, or otherwise communicating with us through the Site.

These Terms govern the Site only. Any booking, reservation, itinerary, event participation, cruise, tour, group departure, transportation arrangement, concierge service, or other travel service offered by Sovereign may also be subject to separate terms, booking conditions, waivers, supplier rules, and cancellation policies. If there is a conflict between these Terms and a specific written booking agreement or supplier contract, the more specific agreement will control for that transaction.

2. Eligibility

You may use the Site only if you are at least 18 years old and legally capable of entering into a binding agreement. By using the Site, you represent and warrant that you meet these requirements.

3. Permitted Use

You may use the Site only for lawful, personal, non-commercial purposes related to learning about our services or communicating with us.

You agree not to:

  • use the Site in violation of any law, regulation, or third-party right
  • submit false, misleading, or fraudulent information
  • impersonate another person or entity
  • interfere with or disrupt the operation or security of the Site
  • attempt to gain unauthorized access to any part of the Site or its systems
  • use bots, scrapers, crawlers, or automated tools to extract Site data without our prior written consent
  • upload or transmit malicious code, spam, or harmful material
  • use the Site in any way that could damage, disable, overburden, or impair it

We may suspend or terminate access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful.

4. No Booking Created by Website Use Alone

Content on the Site is for general informational and promotional purposes only. Use of the Site, submission of a contact form, request for proposal, newsletter signup, or other communication does not create a confirmed booking, reservation, travel contract, advisor-client relationship, or guarantee of service.

A booking or service relationship is formed only when Sovereign accepts your request in writing and, where applicable, required documents are completed and payment is received and processed.

5. Accuracy of Information and Site Content

We try to keep Site content accurate and current, but we do not guarantee that all descriptions, pricing references, itineraries, dates, destinations, availability, supplier information, amenities, photographs, or service details are complete, accurate, current, or error-free.

Travel offerings may change at any time due to supplier changes, weather, political conditions, operational needs, low participation, charter requirements, venue changes, safety considerations, or other factors outside our control. We reserve the right to correct errors and update content without notice.

Photographs, videos, maps, destination descriptions, and testimonials are illustrative only and may not reflect your exact experience.

6. Pricing and Availability

Unless expressly stated otherwise in a separate written offer, all pricing, quotes, estimates, and itinerary concepts shown or discussed through the Site are subject to change without notice and are not guaranteed until confirmed in writing.

Quoted pricing may change due to:

  • airfare fluctuations
  • fuel surcharges
  • taxes and government fees
  • exchange-rate changes
  • supplier price increases
  • availability changes
  • group size changes
  • itinerary revisions
  • port, resort, venue, or operational charges

Availability for cruises, hotels, villas, guides, security arrangements, transportation, and other travel components is not guaranteed until confirmed by the applicable supplier.

7. Third-Party Suppliers

Sovereign may act as an intermediary, planner, curator, advisor, or reseller with respect to travel-related services provided by third parties, including but not limited to cruise lines, airlines, hotels, resorts, destination management companies, tour operators, transportation providers, event venues, guides, security providers, and insurance providers (collectively, “Suppliers”).

Those services are ultimately provided by independent Suppliers, not by Sovereign directly, unless expressly stated otherwise in a separate agreement. Each Supplier has its own terms, conditions, cancellation policies, rules, limitations of liability, privacy practices, and operational requirements. By proceeding with a booking or inquiry, you may also become bound by the applicable Supplier terms.

To the fullest extent permitted by law, Sovereign is not liable for the acts, errors, omissions, representations, warranties, breaches, delays, insolvency, or negligence of any Supplier, nor for any personal injury, death, property damage, loss, accident, delay, inconvenience, cancellation, irregularity, overbooking, labor dispute, quarantine, border restriction, government action, weather event, disease outbreak, criminal act, force majeure event, or other circumstance arising from or related to a Supplier’s acts or failures.

8. Traveler Responsibilities

If you book or participate in travel or event services through Sovereign, you are responsible for:

  • reviewing all booking materials promptly upon receipt
  • providing accurate traveler information
  • ensuring that your name exactly matches your government-issued identification and travel documents
  • obtaining and carrying valid passports, visas, permits, vaccinations, medical documentation, and other required travel documents
  • complying with entry requirements, customs rules, local laws, carrier rules, and security requirements
  • confirming health, mobility, dietary, and accessibility needs in advance
  • obtaining recommended travel insurance where appropriate
  • arriving on time for departures, transfers, and scheduled activities
  • reviewing all applicable Supplier terms and policies

Sovereign is not responsible for losses resulting from your failure to meet these responsibilities, including denied boarding, missed departures, visa denial, lack of documentation, or inability to participate in an itinerary.

9. Health, Safety, and Travel Advisories

Travel involves inherent risks, which may include illness, injury, political instability, criminal activity, terrorism, weather disruptions, transportation interruptions, and changing government restrictions.

You are responsible for evaluating the risks of travel and determining whether a destination or activity is appropriate for you and your party. Sovereign does not guarantee safety at any destination or during any activity. Any health, security, or destination information provided on the Site is general in nature and should not be treated as medical, legal, security, or governmental advice.

Travelers should review official government advisories, entry requirements, public health guidance, and insurance options before travel.

10. Cancellations, Changes, and Refunds

Website content alone does not establish cancellation or refund rights. Any cancellation, rebooking, credit, or refund rights will be governed by the applicable written booking terms and Supplier policies.

Unless otherwise stated in a separate written agreement:

  • deposits may be non-refundable
  • change fees may apply
  • Supplier penalties may apply even if Sovereign’s own planning fees are waived
  • some promotional fares, group space, custom itineraries, charter arrangements, event packages, or special-access experiences may be entirely non-refundable
  • refunds, if any, are subject to actual recovery from Suppliers where applicable

Sovereign is not obligated to issue refunds for losses caused by missed departures, incomplete documentation, weather events, government restrictions, force majeure events, or Supplier defaults unless required by law or expressly stated in a binding written agreement.

11. Force Majeure

Sovereign is not liable for any delay, cancellation, damage, loss, failure, or additional cost resulting from causes beyond its reasonable control, including acts of God, weather, hurricanes, earthquakes, fire, flood, pandemics, epidemics, public health emergencies, quarantines, war, terrorism, civil unrest, labor disputes, government actions, border closures, travel bans, transportation interruptions, utility failures, cyber incidents, Supplier insolvency, or other force majeure events.

If such an event affects travel or services, Sovereign reserves the right to modify itineraries, substitute components, postpone services, cancel arrangements, or pass through Supplier terms, credits, or recovery limitations as applicable.

12. Travel Insurance

Unless explicitly stated in writing, travel insurance is not included. We strongly recommend that travelers purchase appropriate travel insurance, including trip cancellation, interruption, delay, baggage, accident, medical, evacuation, and Supplier default coverage as appropriate to the trip.

It is your responsibility to review the terms, exclusions, and claim procedures of any insurance policy you purchase.

13. User Submissions

If you submit information through the Site, including messages, proposal requests, travel preferences, testimonials, reviews, photos, or other content, you represent that:

  • the information is accurate and lawful
  • you have the right to provide it
  • it does not violate any third-party rights
  • it is not defamatory, obscene, abusive, infringing, or harmful

You grant Sovereign a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, and process such submissions as reasonably necessary to respond to your request, provide services, operate the Site, improve our business, and market our services, subject to our Privacy Policy and any separate written agreement.

14. Privacy

Your use of the Site is also subject to our Privacy Policy and any Cookie Policy we make available. By using the Site, you acknowledge that personal information may be collected, used, and shared as described in those policies.

15. Intellectual Property

All Site content, including text, graphics, logos, branding, layouts, photographs, videos, downloadable materials, and software, is owned by Sovereign or its licensors and is protected by intellectual property laws.

You may view and print limited portions of the Site for personal, non-commercial use only. You may not copy, reproduce, distribute, republish, modify, create derivative works from, publicly display, transmit, sell, license, or exploit Site content without our prior written permission.

“Sovereign Luxury Experiences” and related names, logos, and branding may not be used without our prior written consent.

16. Third-Party Links

The Site may contain links to third-party websites, platforms, booking engines, social media services, or Supplier pages. We provide those links for convenience only. We do not control and are not responsible for third-party content, security, availability, privacy practices, or terms. Your use of third-party sites is at your own risk.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all content and services made available through it are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability.

We do not warrant that:

  • the Site will be uninterrupted, secure, or error-free
  • defects will be corrected
  • the Site or servers are free of viruses or harmful components
  • content will always be complete, accurate, or current
  • the Site will meet your expectations or requirements

18. Limitation of Liability

To the fullest extent permitted by law, Sovereign and its owners, officers, directors, employees, contractors, affiliates, representatives, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, reliance, or punitive damages, including loss of profits, loss of revenue, loss of business opportunity, loss of data, travel disruption, emotional distress, or personal inconvenience, arising out of or related to:

  • your use of or inability to use the Site
  • errors or omissions in Site content
  • any booking inquiry or communication made through the Site
  • the acts or omissions of Suppliers
  • delays, cancellations, overbookings, service interruptions, or force majeure events
  • unauthorized access to or alteration of your transmissions or data

To the fullest extent permitted by law, Sovereign’s total aggregate liability for any claim arising out of or relating to the Site or these Terms shall not exceed the greater of: (a) one hundred U.S. dollars (US $100), or (b) the amount you paid directly to Sovereign solely for access to the Site, if any.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

19. Indemnification

You agree to defend, indemnify, and hold harmless Sovereign and its affiliates, owners, officers, employees, contractors, agents, licensors, and representatives from and against any claims, damages, liabilities, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your breach of these Terms
  • your misuse of the Site
  • your violation of law or third-party rights
  • information or material you submit through the Site
  • your travel conduct, participation, or failure to comply with Supplier or governmental requirements

20. Electronic Communications

By submitting forms or communicating with us through the Site, you consent to receive electronic communications from us related to your inquiry, services, proposals, bookings, or account relationship, including by email, unless prohibited by law. This consent does not override any legal requirement for separate consent to marketing emails or SMS messages where such consent is required.

21. Governing Law

These Terms and any dispute arising out of or relating to the Site or these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

22. Venue and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction and venue of those courts.

If you want a more aggressive business-protection version later, this section can be rewritten to require binding arbitration, a class action waiver, and a jury trial waiver. Those clauses should be reviewed carefully by counsel before use.

23. Seller of Travel Disclosure

If required by applicable law, Sovereign’s travel services may be offered subject to applicable seller-of-travel, consumer protection, registration, and licensing laws. Any required disclosures may also appear elsewhere on the Site or in booking materials.

24. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site. The updated version becomes effective as of the “Effective Date” listed above unless otherwise stated. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the updated Terms.

25. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

26. Entire Agreement

These Terms, together with any policies incorporated by reference and any applicable written booking or service agreement, constitute the entire agreement between you and Sovereign regarding your use of the Site.
